Trusted Attorney for Chapter 13 Bankruptcy Cases

Every case is different and Chapter 7 doesn't work for people who want to retain assets but who have fallen behind on the payments on those assets. Chapter 13 is designed to allow people to retain their assets and restructure the debt on those assets. Under Chapter 13, the Debtor makes payment to the Chapter 13 Trustee for a period of not less than 36 months. Most attorneys include their attorney's fees within the payment to the Chapter 13 Trustee.

The full fee for an experienced bankruptcy lawyer in Chapter 13 cases has been set by the court at $4500.00. There are also court filing fees of $310.00 that must be paid separately. The attorney's fees are usually spread out over the duration of the Chapter 13 plan and are included in the payment that the Debtor pays to the Chapter 13 Trustee.

Most lawyers in this area, experienced or not, charge the full fee of $4500.00 in all cases. But lawyers are not required to charge the full fee. Our office adjusts the attorney's fees downwards according to the difficulty of the case. This, of course, results in a lower monthly payment by the Debtor to the Trustee. Our typical fee is $3000.00 to $3500.00. For basic cases, we charge even less. For difficult cases with "over median" income or several assets, we do sometimes charge the full fee. Those "full fee" cases are rare. Whatever fee we charge, it is always included in the payment to the Chapter 13 Trustee.

A Chapter 13 case is almost always filed with no money paid upfront.
